PERMITTED USE

You agree that you are only authorized to visit, view and to retain a copy of sections/pages of the NY CINEMAS Website for your own personal use, and that you shall not duplicate, download, publish, modify, hack, tamper with, damage the contents in any manner or otherwise distribute the information, data, software, photographs, graphs, videos, typefaces, graphics, music, sounds, and other material on the NY CINEMAS Website (collectively "Content") for any purpose other than to review movies and promotional information, or to purchase tickets for your personal use, unless otherwise specifically authorized by NY CINEMAS to do so. REGISTRATION

Moreover, if any problem is faced in ticket booking by the client, due to malfunction of the website or for any other technical reasons beyond control of NY Cinemas, NY Cinemas shall not be responsible for any kind of compensation or alternative accommodation to the client. Group booking may be cancelled at the authority of NY Cinemas, if such behavior is found to be mischievous or against principal of reasonable trade practices. Online booking is strictly for convenience of clients. No commercial usage is envisaged.

NY CINEMAS or its Representatives shall not be liable for refund of any amount paid for purchasing tickets online or availing any other Services on the NY CINEMAS Website, save and except in the event of proven gross negligence on the part of NY CINEMAS or its Representatives, then NY CINEMAS or its Representatives, as the case may be, shall pay liquidated damages amounting to the actual amount paid by the User and actually received by NY CINEMAS with respect to the purchase of tickets/ updates of member accounts/ purchase of virtual cards / gift voucher amounts / whether through the use of virtual card, credit card charge, card debit card, smart card or cash, which amount shall constitute liquidated damages.

UNDER NO CIRCUMSTANCES SHALL NY CINEMAS OR ITS REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE NY CINEMAS WEBSITE. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF NY CINEMAS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. In consideration of your use of the NY CINEMAS Website, you agree and undertake to defend, indemnify, and hold harmless NY CINEMAS and its Representatives from all liabilities, claims, and expenses, including attorney's fees that arise from your use or misuse of the NY CINEMAS Website. NY CINEMAS or its Representatives reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with NY CINEMAS in asserting any available defenses.

TERMINATION AND OPTING OUT

These Terms are enforceable, in full force and effect, until terminated by either you or NY CINEMAS. Upon termination, you must destroy all Content and materials obtained from NY CINEMAS, in case you are a NY CINEMAS Member you must return the NY CINEMAS Member card to NY CINEMAS, and any and all copies thereof, whether made under the provisions of these Terms or otherwise. The NY CINEMAS Website reserve the right, in its sole discretion, to suspend or cancel any or all of the Services at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of any or all of the Services or if your conduct fails to conform with these Terms or for any other reason whatsoever. NY CINEMAS or the NY CINEMAS Website will immediately terminate any account which it believes, in its sole discretion, is transmitting or is otherwise connected with spamming or any other item listed in clause VI above. In the event you so choose to opt out as a user of any of the Services provided on the NY CINEMAS Website, upon your request the NY CINEMAS Website will remove you and your personal information from its database, thereby cancelling your registration and permit you to opt out of further e-mail contact (excepting notification of major changes to the Services provided by the NY CINEMAS) while still allowing access to the NY CINEMAS Website.

Clauses in these Terms of Use with respect to representations, warranties, disclaimers, covenants, and jurisdiction shall all survive the termination of these Terms of Use by either the concerned NY CINEMAS Websites or you.

PURCHASING TICKETS ONLINE

Children aged 3 years and older will need a separate ticket. 3D glasses will be provided at the cinema for 3D films and must be returned before exiting the premises. These 3D glasses are subject to a charge (refundable or non-refundable), in accordance with each cinema's policy. Ticket holders must comply with the policies established by NY Cinemas Management.

BOOKING OF TICKET

Before finalizing the booking, the user must verify all details of the reservation. NY Cinemas will not accept responsibility for, nor issue a refund for, incorrect bookings made due to user error. If the user encounters issues during the booking process, they should contact the NY Cinemas helpline provided on the booking page. Once the transaction is completed, the Portal will not cancel any bookings. Upon successful booking, the user will receive a confirmation email containing all relevant booking details. NY Cinemas is not responsible for, and will not issue a refund for, tickets purchased incorrectly or if the user fails to meet the age requirements for a particular film. Online bookings are non-transferable and cannot be resold. Outside F&B is not allowed

CANCELLATION OF TICKET

The booking shall be deemed to be cancelled in the following circumstances:- The booking is valid only for the viewing of the film at the specified NY Cinemas. If the booking is not used on the date specified, it will become invalid and non-refundable. NY Cinemas is obligated to comply with and enforce the age restrictions set by applicable laws. If an authorized NY Cinemas representative determines that the user does not meet the minimum age requirement and the user is unable to provide valid photographic proof of age, entry to the performance or film will be denied. Customers currently do not have the option to cancel or modify the date or time of an already booked movie ticket. This service is not available at this time. In the event of any dispute, the decision of NY Cinemas will be final.

GENERAL CONDITIONS

NY Cinemas will make every effort to ensure that showtimes and cinema operations are consistent with advertisements. However, due to circumstances beyond our control, there may be occasions when a film must be cancelled or rescheduled. In such cases, the user may receive a refund for the ticket only. The method of refund will be at the sole discretion of NY Cinemas. If a show is cancelled or if the cancellation is initiated by the management of NY Cinemas LLP, the appropriate formalities will be followed. The user agrees not to take any legal action against NY Cinemas in such instances.

CHANGES TO THE TERMS AND CONDITIONS

We may update these terms and conditions periodically. Any changes made will be reflected in the "Last Updated" date above. By continuing to use our website, app, or platform after such changes are posted, the user agrees to the revised terms and conditions. If we intend to use the user's personal data for a purpose that differs from the original purpose for which it was collected, we will notify the user and seek additional consent.

GENERAL INFORMATION

These Terms and the relationship between you and NY CINEMAS and its Representatives shall be governed by the laws of India. You and NY CINEMAS agree to submit to the personal and exclusive jurisdiction of the courts located in Mumbai, India. The failure of NY CINEMAS to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, then you agree with us that the court should endeavor to give effect to the intentions as reflected in these Terms, and all the provisions of these Terms shall remain in full force and effect. This Agreement represents the entire understanding between you and NY CINEMAS regarding your use of the NY CINEMAS Website and Services provided, whether online or offline). NY CINEMAS reserves the right to change any information on the NY CINEMAS Website including but not limited to revising and/or deleting Services, features Content, or other information without any prior notice to you.

We remind you again that you have expressly agreed that your use of the NY CINEMAS Website and Services provided by NY CINEMAS and on the NY CINEMAS Website are at your sole risk. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms of Use must be filed within 6 months after such claim or cause of action arose or be forever barred.
